Please read these Terms & Conditions ("Terms") carefully before subscribing to or using Fawkes Community ("we," "us," "our," or "Fawkes"). By making a payment, creating an account, or accessing our community platform, you ("Member," "User," or "you") agree to be bound by these Terms. If you do not agree, please do not subscribe to or use our services.
1. About Fawkes Community
Fawkes Community is a digital subscription-based platform offering curated written insights on markets, history, assets, geopolitics, fashion, and related topics. Membership is delivered entirely online through our private community hosted on the Heartbeat platform, accessed via redirection from our website after successful payment.
2. Membership & Access
- Membership is available on a monthly recurring basis at ₹99/month, or such other price as may be communicated on our website from time to time.
- Payment is collected via our website's payment gateway, after which verified members are redirected to our private Heartbeat community.
- Access is granted only after successful payment verification. It is your responsibility to ensure you provide accurate contact and payment details at checkout.
- Membership is personal to you and non-transferable. You may not share your login credentials or community access with any third party.
3. Payments & Billing
- All fees are billed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- Membership renews automatically every month unless cancelled by you prior to the next billing date.
- You are responsible for maintaining a valid payment method on file. Failure to do so may result in suspension of access until payment is resolved.
- All payments are non-refundable, except in cases of duplicate charges or failed access delivery, as outlined in our [Refund Policy](https://www.fawkescommunity.com/refund-policy).
4. Cancellation
- You may cancel your membership at any time through your account settings or by contacting us at [info@fawkescommunity.com].
- Cancellation stops future billing but does not entitle you to a refund for the current billing period already paid for.
- You will retain access until the end of the period already paid for, after which access will be revoked.
5. Content & Intellectual Property
- All content shared within Fawkes Community — including articles, insights, commentary, graphics, and discussions posted by us — is the intellectual property of Fawkes Community unless otherwise credited.
- Content is provided for personal, non-commercial use only. You may not copy, reproduce, redistribute, publish, screenshot for redistribution, or resell any content from the community without our prior written consent.
- Insights and commentary shared in the community are for informational and educational purposes only and do not constitute financial, investment, legal, or professional advice. Fawkes Community does not guarantee the accuracy, completeness, or timeliness of any information shared, and is not liable for decisions made based on it.
6. Member Conduct
By joining Fawkes Community, you agree that you will not:
- Share, forward, or leak paid content outside the community
- Harass, abuse, or behave disrespectfully toward other members or moderators
- Use the community for solicitation, spam, or promotion of unrelated products/services without permission
- Attempt to disrupt, hack, or misuse the Heartbeat platform or our website
We reserve the right to suspend or terminate any member's access, without refund, if these conduct guidelines are violated.
7. Third-Party Platforms
Our community is hosted on Heartbeat, a third-party platform. While we curate the community experience, availability, uptime, and certain functionalities are dependent on Heartbeat's platform and are outside our direct control. We are not liable for outages, bugs, or downtime caused by third-party service providers.
8. Changes to Membership Fees or Terms
We reserve the right to modify membership pricing, features, or these Terms at any time. Material changes will be communicated to active members in advance via email or community announcement. Continued use of the community after such changes constitutes acceptance of the updated Terms.
9. Limitation of Liability
To the maximum extent permitted by law, Fawkes Community and its team shall not be liable for any indirect, incidental, or consequential damages arising from your use of the community, reliance on shared content, or inability to access the platform due to technical or third-party issues.
10. Termination
We reserve the right to terminate or suspend any member's account at our discretion, including for breach of these Terms, without obligation to provide a refund for the remaining subscription period.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in [your city/state].
